Amendments to the Rules and Regulations enter into force 03/18/2021

11 Jan 2021

We would like to inform you that from 18 March 2021 the new Rules and Regulations of Walutomat.pl will come into force.

We have introduced changes to the Rules and Regulations in connection with the development of the Walutomat.pl website and making new functionalities available.

We have merged the two existing sets of rules and regulations into one document: the Rules and Regulations of the Walutomat.pl website and the Rules and Regulations for the provision of payment services. The new Rules and Regulations (Rules and Regulations of the Walutomat.pl website) replace both existing sets of rules and regulations.

What do the Rules and Regulations change?

  • They will extend the functionality of existing Payment Accounts and open new Payment Accounts for Users who have not used the payment services yet.
  • Upon the entry into force of the Rules and Regulations each user will have the opportunity to fund his or her Payment Account using various payment methods and to make withdrawals from that account as well as other transfers.
  • They reduce the cost of withdrawals to mBank retail division…
  • … without increasing or adding any other charges.

The uniform content of the new Rules and Regulations of the Walutomat.pl website is available at the address: https://www.walutomat.pl/wp-content/uploads/2021/01/regulamin-walutomatu_ang_obowiazujacy_od_18_03_2021.pdf

All changes have been made on the basis of the previously binding Rules and Regulations of the Walutomat.pl website (§ 38 sections 1, 2, 6) and the Rules and Regulations for Payment Services (§ 11 sections 1, 2, 6).

All accounts that were marked in the User Panel as so-called Trusted Accounts (i.e. accounts that we did not ask for the SMS code when withdrawing to this account) will also be regarded as trusted under the new Rules and Regulations, i.e. they will constitute Trusted Accounts within the meaning of the new Rules and Regulations.

In addition, it should be remembered that :

For Clients of the Basic Rules and Regulations

For Customers who have also accepted the Rules and Regulations for the provision of payment services (making withdrawals to payee accounts)

Until 17 March 2021, you may decide whether you wish to continue using our services under the conditions proposed in the new Rules and Regulations.

You can express your decision in several ways:

1) you may not do anything before the above mentioned date. This will mean that you agree to the above mentioned change of the Rules and Regulations; in such a case you will continue to be a User under the conditions already set out in the new Rules and Regulations;

2) you may also provide us with a statement before that date in which you expressly agree to the change to the Rules and Regulations; also in this case you will continue to be a User under the conditions already set out in the new Rules and Regulations;

3) however, if you do not agree with this change, you can terminate your agreement with immediate effect before the above date, without any charges; we would like to remind you that termination must be made in the form provided for in the existing rules and regulations;

4) if you do not terminate the agreement, but nevertheless raise an explicit objection to this change to the Rules and Regulations before that date, the existing agreement will expire on the day preceding the date of entry into force of the proposed amendments.

We encourage you to read the content of § 38 and § 29 section 2 of the existing rules and regulations, in order to familiarize yourself with the provisions concerning the issues mentioned above.

3) however, if you do not agree to this change, you may terminate both agreements before the above date, i.e. the agreement referred to in the Rules and Regulations of Walutomat.pl and the framework agreement referred to in the Rules and Regulations for the provision of payment services, with immediate effect, without incurring any fees; we would like to remind you that the termination must be made in the form provided for in the existing rules and regulations;

4) if you do not terminate the agreements referred to above, but nevertheless raise an explicit objection to this change to the Rules and Regulations before that date, the existing agreements will expire on the day preceding the date of entry into force of the proposed amendments.

We would like to draw your attention to the fact that the new Rules and Regulations replace both sets of the existing Rules and Regulations, so you can either accept the amendment to the Rules and Regulations only in its entirety or oppose it only in its entirety. Thus, if, pursuant to items 3) or 4) above, you declare the termination of at least one of these two agreements, or you object to changes in connection with one of these agreements, the other agreement will also terminate or expire at the same time as the agreement on which you have expressed your position.

We encourage you to read the content of § 38 and § 29.2 of the current Rules and Regulations of Walutomat.pl and § 11 and § 9.2 of the current Rules and Regulations for the provision of payment services, in order to familiarise yourself with the provisions concerning the issues discussed above.
